Is the 2017 Chevrolet Cruz Diesel guilty as charged? This is something that we are going to find out as part of the lawsuit against Chevrolet that alleges they cheated in emissions testing is going to go ahead.

A judge in Michigan has revealed the order claiming deceptive advertising along with fraudulent concealment is going to go ahead. The part of the lawsuit that alleged breach of contract is going to be dismissed though.

Nine owners of the Chevrolet Cruze Diesel are behind the lawsuit and they allege that their vehicle had an emissions cheat device fitted and they want a buyback, compensation and reimbursement of $2,000 for the premium that they had to pay over the petrol version of the Cruze.

It has been suggested that the defeat device of Chevrolet worked in the same way as that of the one of Volkswagen and it only triggered during testing of the vehicle and deactivated once the vehicle was being used.

A spokesperson for GM said that they were confident that the other claims would fail just as the breach of contract demands was dismissed.
